As of April 5, 2021, health care providers (defined broadly) are required to comply with “information blocking” regulations implemented by the Office of the National Coordinator for Health IT (ONC) under the 21st Century Cures Act. Broadly speaking, healthcare providers (and others) must eliminate practices that interfere with patients’ ability to easily access their electronic health information (EHI). Examples of “information blocking” include:
Healthcare providers are not required to buy new or different EMR technology if they do not already have such technology, however, providers are required to work with requestors to find alternative ways to provide EHI, where technical limitations exist. The rules also do not replace obligations under HIPAA to provide patients with access to protected health information, although in many cases fulfilling a patient’s EHI request under the Rule is likely to satisfy HIPAA requirements.
